Welcome to YAFAWI. The terms "we", "us" and "our" refer to YAFAWI. YAFAWI operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with our products and services (the "Services").
YAFAWI is operated in Belgium as a sole proprietorship and uses Shopify to power its online store.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services or purchase products from us.
Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy.

Nothing in these Terms limits any mandatory rights granted to consumers under Belgian or European Union law.
SECTION 1 - ACCESS AND ACCOUNT
By using the Services, you confirm that you have the legal capacity required under the laws applicable to you to enter into a purchase agreement.
To use certain features of the Services or place an order, you may be asked to provide information including your name, email address, billing information, payment information and shipping address.
You agree that the information you provide is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account.
You may not transfer, sell or assign your customer account to another person.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display and describe our products accurately.
However, colors and product appearance may vary slightly depending on your device, screen settings, manufacturing process, printing method or other factors.
Because many YAFAWI products are produced on demand, minor variations may occur between individual items.
Product descriptions, designs, specifications and availability may be updated or changed when reasonably necessary.
We reserve the right to discontinue products or limit availability in particular countries or regions.
Nothing in this section affects your mandatory consumer rights or the legal guarantee applicable to goods sold to consumers.
SECTION 3 - ORDERS
When you submit an order, you are making an offer to purchase the selected products.
After receiving your order, we will send you an electronic confirmation. An order may be rejected or cancelled where there is a legitimate reason, including payment failure, suspected fraud, pricing or product errors, inability to fulfil the order, or product unavailability.
Where we cancel an order after payment has been taken, any amount due to you will be refunded using the original payment method.
Please review your order carefully before submitting it. Because products may enter production shortly after an order is confirmed, requests to modify or cancel an order cannot always be accommodated.
This does not affect any statutory cancellation or withdrawal rights that apply to consumers.

Products purchased from our store are intended primarily for personal or household use unless otherwise agreed.
SECTION 4 - PRICES AND BILLING
Prices displayed on our store are the prices payable for the products, subject to any shipping, delivery, customs or other charges that are clearly disclosed before completion of the order.
Any VAT or other taxes that YAFAWI is legally required to charge will be handled in accordance with applicable law.
Shipping charges, where applicable, will be displayed during checkout before you place your order.
For international orders, customs duties, import taxes or other charges may be imposed by the destination country. Where such amounts are not collected by us at checkout, they may be payable by the customer to the relevant authorities or carrier.
Prices, discounts and promotions may change from time to time. Changes do not affect orders that have already been confirmed.
You agree to provide accurate and complete billing and payment information.
You confirm that you are authorized to use the payment method provided for your purchase.
SECTION 5 - SHIPPING AND DELIVERY
Products sold by YAFAWI may be produced and fulfilled by third-party production and fulfilment partners.
Delivery estimates shown on our website or during checkout are estimates and may include production and shipping time.
Actual delivery times may vary because of production schedules, destination, carrier operations, customs processing, public holidays or circumstances outside our reasonable control.
Where mandatory consumer law applies, the risk of loss or damage to the goods remains with YAFAWI until you, or a third party designated by you other than the carrier, physically receive the goods.
If you experience a delivery problem, please contact us at contact@yafawi.be so that we can investigate it with the relevant fulfilment or shipping provider.

SECTION 6 - INTELLECTUAL PROPERTY
Unless otherwise indicated, the content available through the Services, including YAFAWI branding, designs, graphics, artwork, photographs, text, logos, product presentations and other materials, is owned by or licensed to YAFAWI and is protected by applicable intellectual property laws.
You may access and use the Services for personal and non-commercial purposes.
Except where permitted by law or with our prior written permission, you may not reproduce, distribute, modify, commercially exploit, republish or create derivative works from materials owned by YAFAWI.
Nothing in these Terms transfers ownership of YAFAWI's intellectual property to you.
The Shopify name, trademarks and related intellectual property belong to Shopify or its licensors.
Other third-party names, trademarks and content remain the property of their respective owners.
SECTION 7 - OPTIONAL TOOLS
We may provide access to features or tools supplied by third parties.
These tools may be governed by the terms and privacy practices of their respective providers.
We do not control third-party services and cannot guarantee their availability or continued operation.
Your use of optional third-party tools is subject to applicable law and any terms governing those services.
We may introduce new features, tools or services in the future. Unless otherwise stated, those features will form part of the Services and may be subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
Our Services may contain links to websites, applications or services operated by third parties.
We are not responsible for the content, privacy practices, availability or operation of third-party websites or services that are outside our control.
Before purchasing products or services from a third party, you should review that third party's applicable terms and policies.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
YAFAWI is powered by Shopify, which provides technology that enables us to operate our online store.
However, purchases made through our store are made directly between you and YAFAWI.
Shopify is not the seller of YAFAWI products and is not responsible for fulfilling your purchase or providing the products sold by YAFAWI.
Your contractual relationship regarding the purchase of YAFAWI products is with YAFAWI.

Because our store is powered by Shopify, Shopify and other service providers may process certain personal information where necessary to provide their services.

SECTION 11 - FEEDBACK
If you voluntarily submit reviews, comments, suggestions, photographs, feedback or other content to us, you confirm that you have the necessary rights to provide that content.
Where you submit content for publication or promotional use, you grant YAFAWI a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content to the extent reasonably necessary to operate, improve or promote the Services.
You must not submit content that infringes the rights of another person, is unlawful, fraudulent, defamatory, abusive or contains malicious software.
Nothing in this section affects rights that cannot legally be waived under applicable law.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates or availability.
Where permitted by law, we may correct such errors and update inaccurate information.
If an error materially affects an order you have already placed, we will contact you where appropriate and provide any rights or remedies required under applicable law.

Automated access must comply with applicable law, these Terms and any technical requirements communicated by YAFAWI or Shopify.
We may restrict automated access where necessary to protect the security, availability or integrity of the Services.
SECTION 15 - TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access to an account or to certain Services where reasonably necessary because of fraud, unlawful activity, security risks, misuse of the Services or a material breach of these Terms.
Termination does not affect rights or obligations arising from purchases or transactions completed before termination, nor any mandatory consumer rights.
Provisions that by their nature are intended to continue after termination will remain effective.
SECTION 16 - WARRANTIES AND CONSUMER RIGHTS
Nothing in these Terms excludes or limits any mandatory legal guarantee, warranty, remedy or consumer right available under Belgian or European Union law.
Consumers purchasing goods in the EU benefit from statutory rights when goods are defective, do not conform to the contract or do not correspond to what was advertised.
Where applicable, YAFAWI remains responsible to the customer for providing the remedies required by law, even where production, printing, fulfilment or shipping is performed by a third-party partner.
Any commercial warranty or other voluntary commitment offered by us is additional to, and does not replace, your statutory rights.
EU rules generally provide consumers with a minimum two-year legal guarantee for goods that are faulty or do not conform to what was agreed.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
In particular, nothing in these Terms limits mandatory consumer rights, statutory guarantees or remedies available under Belgian or European Union law.
To the extent permitted by applicable law, YAFAWI will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.
We are not responsible for losses caused solely by events outside our reasonable control, provided that this does not remove any obligations or remedies that applicable law requires us to provide.
Any limitation of liability in these Terms applies only to the extent legally permitted.
SECTION 18 - CUSTOMER RESPONSIBILITIES
You agree not to misuse the Services or knowingly provide fraudulent or unlawful information.
To the extent permitted by applicable law, you may be responsible for losses directly resulting from your unlawful use of the Services or your material violation of these Terms.
Nothing in this section imposes liability on a consumer beyond what is permitted under applicable law.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted by law or, where necessary, treated as severed from these Terms.
The remaining provisions will continue to apply.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
If we do not immediately exercise or enforce a right under these Terms, this does not mean that we waive that right.
These Terms, together with the policies and information incorporated into them, form the agreement governing your use of the Services and purchases from YAFAWI.
Nothing in this section limits information, representations or consumer rights that applicable law requires to form part of the contract.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would materially affect the contractual relationship without our consent, except where applicable law provides otherwise.
YAFAWI may transfer rights or obligations relating to the operation of the business where legally permitted, provided that doing so does not reduce your mandatory consumer rights.
SECTION 22 - GOVERNING LAW
These Terms and agreements through which YAFAWI provides products or Services are governed by the laws of Belgium.
If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the laws of your country of residence.
Nothing in these Terms restricts any right a consumer may have to bring proceedings before a court that has jurisdiction under applicable Belgian or European Union law.

The headings used in these Terms are provided for convenience and do not affect the interpretation of the provisions.
SECTION 24 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.

Material changes will be communicated where required by applicable law.
Changes to these Terms will not retroactively remove statutory rights or contractual rights relating to orders already completed.
